{"id":3641,"date":"2004-12-11T13:14:54","date_gmt":"2004-12-11T17:14:54","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/cmusings\/2004\/12\/11\/next-questions-about-grokster\/"},"modified":"2004-12-11T13:14:54","modified_gmt":"2004-12-11T17:14:54","slug":"next-questions-about-grokster","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/cmusings\/2004\/12\/11\/next-questions-about-grokster\/","title":{"rendered":"Next Questions about Grokster"},"content":{"rendered":"<p><a name='a986'><\/a><\/p>\n<p><P>(Some off the top of my head thoughts that are not really that novel but that I want to jot down anyway:)<\/P><br \/>\n<P>First biggie: how is <EM>Sony <\/EM>treated as precedent?<\/P><br \/>\n<P>A wholesale reverseal of <EM>Sony <\/EM>seems unlikely.&nbsp; Instead, one could casually make some distinctions, as the district court opinion in <EM>Aimster <\/EM><A href=\"http:\/\/www.techlawjournal.com\/courts2001\/aimster\/20020904.asp\">did.<\/A>&nbsp; None of those distinctions seem particularly reasonable to me, but that doesn&#8217;t me the Court won&#8217;t use them.&nbsp; If the Court does go this route, it will be important which distinction they choose to make.<\/P><br \/>\n<P>Second, how does this affect those arguing on behalf of Grokster and Streamcast?&nbsp; Obviously, they will need to highlight how the Court should be bound by what they said in <EM>Sony <\/EM>and how, as the 9th Circuit demonstrated, those rules clearly apply here.&nbsp; At the same time, unlike in the courts below, it seems hard to believe that that alone will carry the day.&nbsp; The normative arguments will play a much bigger role &#8211; what is the judicial system&#8217;s role here?&nbsp; why is <EM>Sony <\/EM>as interpreted below the best rule?&nbsp; what are the costs of changing it?<\/P><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Some off the top of my head thoughts that are not really that novel but that I want to jot down anyway:) First biggie: how is Sony treated as precedent?
